The petitioner, who was living in rented accommodation near Guwahati, had submitted several records to support his claim, including computer-generated copies of the 1951 National Register of Citizens, old voter lists, a 1973 land purchase deed, a school certificate, PAN card, voter ID card and oral testimony from his father. However, the court held that the documents either did not meet legal evidentiary standards or failed to establish a clear and continuous family link to the claimed Indian ancestors. The Bench noted that under Section 9 of the Foreigners Act, 1946, the burden of proving that a person is not a foreigner lies on the individual concerned, and in this case the petitioner had not discharged that burden. One of the key issues was that the 1951 NRC records were treated as computer-generated copies without the required certification, while the school certificate was not supported by testimony from the issuing headmaster or the school admission register. The land deed was also found insufficient because the petitioner could not clearly show how the property passed through the family line. The court further observed inconsistencies in voter lists, including age mismatches, names appearing across different villages and lack of reliable proof connecting those entries to one continuous family lineage. It also reiterated that PAN cards and voter ID cards may prove identity for limited purposes but are not conclusive proof of citizenship. The ruling highlights how citizenship cases in Assam often depend not on the number of documents produced, but on whether those records are legally admissible, consistent and capable of proving an unbroken ancestral link.
